What rights a natural person has:

In proceedings for the issue of a certificate of a natural person and in proceedings for the revocation of the validity of a certificate, a natural person shall have the right to:

1. before the decision nand inspect the unclassified part of the security file and take excerpts from it (Section 89c of the ActSection 124 of the Act),

2. to be represented a lawyer or other representative of your choice (Sections 92e and 92f of the Act),

3. give decomposition against the decision of the Office issued in the security proceedings (Section 125 of the Act),

4. take a written request for the issue of a certificate back (Section 113(1)(a) of the Act) – only in proceedings for the issue of a certificate of a natural person,

5. ask in writing for stay of proceedings for a reason that prevents him from participating in the proceedings on a long-term basis, for a maximum period of 60 days – a stay of proceedings may be requested no more than twice (Section 112(1)(e) of the Act),

6. object to bias within 15 days of becoming aware of the official involved in the proceedings, the objection must be substantiated (Section 90(3) of the Act).

7. return the certificate natural persons to the person who issued it, including in the event of the initiation of proceedings for the revocation of the validity of a natural person’s certificate; in this case, the certificate will lapse and the proceedings will be discontinued (Section 56(1)(j) of the Act),

8. in writing ask within 15 days Office on the issue of a new certificate natural persons, if its validity has expired by reporting its theft, loss or damage (Section 56(4) of the Act).

What are the duties of a natural person:

Holder of a notification for access to RESTRICTED classified information (Section 9(6), Section 10(2) of the Act) shall, in particular, be required to:

1. communicate in writing the person who issued the notice changes concerning the condition legal capacity and conditions of good repute, within 15 days from the date on which the change occurred,

2. communicate in writing the person who issued the notice changes to the particulars to be included in the notification (first name, surname, nationality) within 30 days of the date on which the change occurred;

3. communicate in writing the person who issued the notice Theft, loss or damage of notifications, within 15 days from the date on which the fact occurred or became known to the natural person,

4. communicate in writing the person who issued the notice den delivery of the natural person’s certificate or proof of security, within 15 days of the date on which the event occurred,

5. communicate in writing the so-called providers of classified information, in cases where a notification is issued by the Office of the Office, establishment of a service relationship or an employment, membership or similar relationship, in which a natural person is to be given access to classified information within 15 days of the date on which this occurs;

6. at the request of the person who issued the notification, submit within the set time limit Declaration of legal capacity and extract from the Criminal Register (may not be older than 3 months) - if the integrity is assessed by a state authority, it may request an extract from the Criminal Register itself. A foreign national shall also submit a similar document to the State of which the foreign national is a national if he/she has resided there for a continuous period of more than 6 months after reaching the age of 15 years, as well as to the State in which the foreign national has resided for a continuous period of more than 6 months in the last 10 years, or an extract from the Criminal Register with an annex containing information entered in the criminal records of such State. If the foreign state does not issue a document similar to an extract from the criminal record, the foreigner proves the condition of good repute by a solemn declaration (documents may not be older than 3 months),

7. return notification to the person who issued the notice upon its expiry by delivery of a written notice that the natural person no longer fulfils the condition of legal capacity or good repute, within 15 days from the date of delivery of this notice,

8. return notification the person who issued the notification upon termination of its validity by delivering a written notification that the natural person has not fulfilled the obligation to submit an extract from the Criminal Register within the prescribed period, in the case of a foreign national, a similar document of the State of which the foreign national is a national, if he/she has resided there for a continuous period of more than 6 months after reaching the age of 15 years, as well as of the State in which the foreign national has resided for a continuous period of more than 6 months in the last 10 years, or an extract from the Criminal Register with an annex containing information that is registered in the Criminal Register of such a State. If the foreign state does not issue a document similar to an extract from the criminal record, the foreigner proves the condition of good repute by a solemn declaration, and a declaration of legal capacity, within 15 days from the date of delivery of this notification,

9. return notification the person who issued it, when changing the data (first name, surname, citizenship), within 30 days from the date of the change of data,

10. return notification to the person who issued it, upon termination of service or employment, membership or similar relationship, within 15 days from the date of such termination,

11. Return notification the so-called provider of classified information, in cases where a notification is issued by the Office, in the event of the establishment of a service relationship or an employment, member or similar relationship, within 15 days from the date of such establishment,

12. return notification to the person who issued it, where the natural person has been issued with a natural person certificate or a security certificate within 30 days from the date of delivery of the natural person certificate or document.

Holder of a natural person certificate CONFIDENTIAL, SECRET, TOP SECRET or natural persons for foreign power ("NATO Certificate") (Section 66(1), Section 57(11) of the Actshall, in particular, be required to:

1. surrender within 15 days public document to the person who issued it, if it has expired:

a) a decision revoking the validity of a certificate of a natural person (certificate and "NATO certificate"), filing an appeal against this decision does not have suspensive effect,

b) by reporting damage to the certificate of a natural person, that the entries in the certificate of a natural person are illegible or its integrity has been violated (certificate);

c) by reporting damage to the certificate, that entries in the "NATO certificate" are illegible or its integrity has been violated ("NATO certificate"),

d) if the certificate of a natural person has expired due to the establishment of the service relationship of a member of the intelligence service or the employment relationship of an employee assigned to the intelligence service, in the case of a public document issued by the Office (the certificate and the "NATO certificate" shall be returned to the Office),

e) if the certificate of a natural person ceases to be valid upon termination of the service relationship of a member of the intelligence service or employment relationship of an employee assigned to the intelligence service, or on the date on which the natural person ceases to be a person referred to in Section 141(1) of the Act, in the case of a public document issued by the intelligence service or the Ministry of the Interior (certificate and "NATO certificate"), the "NATO certificate" issued by the Office shall be returned to the Office;

f) the date of delivery of the new certificate of a natural person (certificate and "NATO certificate").

2. notify immediately loss, theft or damage a certificate from a natural person or a 'NATO certificate',

3. notify immediately changes data in the questionnaire of a natural person (exhaustive list) – more information on reporting changes – here (This obligation is also laid down in the course of the proceedings).

In connection with compliance with the obligations laid down by law, it is appropriate, in relation to the above-mentioned obligations, to point out that in the event of a breach of certain obligations, such conduct may be classified as an offence. For such an offense (Sections 148, 150, 151 of the Act) a fine of up to CZK 50,000 may be imposed.

Holder of a certificate of a natural person who needs to have access to classified information after the expiry of the current certificate of a natural person, is obliged to apply for the issue of a new certificate before the expiry of the current certificate within the legal period (Section 94(3) of the Act).
