Rights of the natural person in the procedure for issuing a security certificate and in the procedure for revoking the validity of a security certificate:

1. before a decision is taken inspect the unclassified part of the security file and take excerpts from it (Section 89c of the Act, Section 124 of the Act),

2. to be represented a lawyer or other representative of your choice (Sections 92e and 92f of the Act),

3. give decomposition against the decision of the Office issued in the security proceedings (Section 125 of the Act),

4. take in writing request to issue a return document (Section 113(1)(a) of the Act) – only in the procedure for issuing a document,

5. ask in writing on the stay of proceedings for a reason that prevents you from participating in the proceedings for a long time, for a maximum period of 60 days – a stay of proceedings can be requested no more than twice (Section 112(1)(e) of the Act),

6. object to bias a public official within 15 days from the date on which you became aware of the public official involved in the proceedings; the objection must be substantiated (Section 90(3) of the Act),

7. return the document to the Office, including in the event of the initiation of an invalidation procedure, in which case the validity of the document will lapse and the procedure will be discontinued (Section 85(3)(b) f)),

8. request in writing within 15 days Office on the issue of a new document, if its validity has expired by the declaration of its theft or loss or its damage (Section 85(4) of the Act). 

 

Obligations of the natural person

Holder of the document (Section 87(1) of the Act) shall, in particular, be obliged to:

1. surrender within 15 days Office document, if it has expired:

a) the decision of the Office on the revocation of the validity of the document (the date of delivery of this decision); filing an appeal against that decision does not have suspensive effect;

b) by reporting damage, that the entries in the document are illegible or its integrity has been violated,

c) the date of delivery of the certificate of the natural person or a new document,

2. report the loss or theft of the document without delay,

3. notify without delay changes to the data in the questionnaire (exhaustive list) – more information on reporting changes – here (This obligation is also laid down in the course of the proceedings).

In connection with compliance with the obligations laid down by law, it is appropriate, in relation to the above-mentioned obligations, to point out that in the event of a breach of certain obligations, such conduct may be classified as an offence. For such an offense (Section 148 a Section 152 of the Act) a fine of up to CZK 50,000 may be imposed.

The holder of a document who needs to carry out a sensitive activity after the expiry of the current document is obliged to apply for a new document before the expiry of the current document within a period of at least 5 months (Section 99(3) of the Act).
