Proof of safety capability (hereinafter referred to as ‘the document’) is a public document - a model document - here.

Validity document (Section 85(1) of the Act) is 10 years from the date of issue.

Validity document ceases to exist (Section 85(3) of the Act):

  1. the expiry of the period of validity of the document, the death of a natural person or if declared dead,
  2. invalidation of the document (the date of enforceability of the decision of the National Security Authority (‘the Office’) to invalidate it);
  3. reporting the theft or loss of a document;
  4. reporting document damage (resulting in illegibility of data, breach of integrity),
  5. return of the document to the Office,
  6. the date of receipt of the natural person's certificate or new document.

If the holder of a security certificate is requested to issue a new document pursuant to Section 99(3) of the Act and the procedure for such an application is affected by the declaration of a state of crisis for the entire territory of the Czech Republic, he or she may carry out sensitive activities even after the expiry of the validity of the document in his or her possession due to the expiry of its validity (point 1), until the Office decides on his or her new application, but no longer than 12 months after the expiry of its validity. In this case, the Office shall not issue a document replacing the original or any other attestation. In cases of lapse of validity of the document referred to in point 2, 4 and 6 the natural person has an obligation return the document the Office within 15 days (Section 87(1)(a) of the Act).

In the event that the document referred to in point 1 ceases to be valid, the document shall not be returned to the NSA.

In case of theft, loss, damage document the natural person is obliged to report this fact without delay (Section 87(1)(b) of the Act).

By violating these obligations, which include the obligation to report a change in the information given in the questionnaire, a natural person commits an offence for which a fine of up to CZK 50,000 may be imposed (Section 148 a Section 152 of the Act).

In cases of lapse of validity of the document referred to in point 3 and 4 the Office shall issue on the basis of a written request within 5 days of receipt of the request a new document (Section 85(4) of the Act). This application must be submitted within 15 days of the date of expiry of the document.

Warning

If no application is submitted within the prescribed time limit, the possibility of carrying out a sensitive activity will cease and the natural person will have to submit a new complete application in accordance with the law if it is necessary to carry out a sensitive activity in the future, i.e. he will submit the first application for the issue of a document - the exact list of documents that the natural person will be obliged to submit can be found here: here

The document does not cease to be valid in any other way than the above, i.e. it does not cease to be valid, for example, by terminating the employment/service relationship or by terminating the performance of a sensitive activity.

The document shall also not cease to be valid if the particulars contained therein are changed. In the event of a change in the information contained in the document, the Office shall itself issue a new document without delay. The performance of a sensitive activity shall not be affected until the receipt of the new document.
