TRANSFERS (REFERENCE) (Sections 148 to 155)

Against the decision of the Office on the offence can be filed decomposition pursuant to Section 152 and the following Act No. 500/2004 Coll., the Code of Administrative Procedure (hereinafter referred to as the ‘Code of Administrative Procedure’).

The decomposition is filed with the Office (Section 86(1) of the SR) within 15 days from the date of service of the decision (Section 83 of the SR).

Timely and admissible decomposition has suspensive effect.

Terms and conditions decomposition is referred to in Section 82(2) of the SR. If the dissolution does not have the requisite elements, the party to the proceedings may be requested to remove them within a reasonable period.

Officeif it finds that there are grounds for doing so, it may annul or amend the contested decision in so far as: comply decomposition (Section 87 of the SR); otherwise forwards the file material together with its opinion to the Director of the Office (Section 88(1) of the SR).

Director of the Office decide on the decomposition on the basis of a proposal from the decomposition committee. In the appeal proceedings, it shall annul or amend the contested decision in so far as it fully: comply decomposition, otherwise decomposition rejects (Section 152(5) of the CCP).

The decision on decomposition shall be issued within the time limits laid down in Section 71 of the Code of Civil Procedure.

Against the decision to dissolve can no longer be revoked (Section 91(1) of the CCP).

CERTIFICATION (Sections 46 to 53)

Against the decision of the Office on the non-issuance or lapse of validity of the certificate can be filed decomposition (revocation), with the exception of the certificate of the information system and the certificate of the cryptographic product (Section 46(10) and (11)).

Proceedings on decomposition are regulated in § 152 and the following Act No. 500/2004 Coll., the Code of Administrative Procedure (hereinafter referred to as the ‘Code of Administrative Procedure’).

Dispute against the decision of the Office on the expiry of the certificate has no suspensive effect (Section 46(11)).
