Sensitive civil aviation activities

On 13 January 2005, the Government Regulation laying down a list of sensitive activities for civil aviation (hereinafter referred to as the "Regulation") was published in the Collection of Laws under No. 31/2005. On the basis of the classification of the activities listed in the Regulation as sensitive activities, any natural person must be engaged in such an activity, on the date of entry into force of the Regulation, holder of a security clearance document.

On 13 January 2005, the National Security Authority began receiving applications for on the issue of security clearance documents from natural persons carrying out sensitive activities referred to in the Regulation (or their statutory bodies).

The NSA should terminate the verification of security capability within 3 months from the date of receipt of the application, if the verification cannot be verified within the set time limit, this time limit may be extended by a further 3 months.

In view of the effectiveness of the Regulation, all natural persons carrying out any of the activities referred to in the Regulation at airports designated for commercial air transport by 1 July 2005 should fulfil the conditions for carrying out a sensitive activity. Given the expected number of applications that will be received in a short period of time, it is not possible to ensure that all applications will be processed by that date, however, the National Security Authority will proceed in such a way that the operation of airports and the activities of business entities covered by the Regulation are not jeopardised when processing applications, as well as when carrying out subsequent state supervision in the field of safety capability, during this transitional - deployment period.
