Any first application for the issue of a natural person’s certificate submitted pursuant to Act No 412/2005 on the protection of classified information and security capacity, as amended (‘the Act’), must contain all the elements laid down by law.
In the case of a second and subsequent application for a natural person’s certificate, with the exception of the basic items, only the changes that have occurred in the items listed in the natural person’s questionnaire after the application was submitted or since the last reported change in the relevant item of the questionnaire shall be filled in. Changes in data for which the legislation so provides - Decree No. 527/2005 Coll., on personnel security, must be supported by originals or officially certified copies of documents.
In the case of reporting changes to the information given in the application during the period of validity of the public document, the Act does not expressly provide for the obligation to document the changes with originals or officially certified copies of documents, but the documenting of changes in accordance with the implementing regulation is not a defect, since the National Security Authority (hereinafter referred to as the “Office”) in some cases, after studying the reported change, requests the documenting of the change in an appropriate manner, i.e. originals or officially certified copies of documents, in accordance with the provisions of Section 110 of the Act.
Since, at the second and subsequent application, certain changes must be documented in the manner laid down in the implementing regulation, a situation may arise in which, although the change was reported during the period of validity of the public document, it was not substantiated in an appropriate manner (voluntarily or at the request of the Office), and the applicant will have to restate this change in the questionnaire and substantiate it in the prescribed manner precisely in the context of any subsequent application.
If, during the period of validity of the public document, the holder of the public document notifies the Office of changes in data that need not be further substantiated within the meaning of the legislation, he shall no longer indicate such changes in the subsequent application for the issue of a certificate of a natural person. A similar procedure is also applied if, during the period of validity of the certificate of the natural person, changes were reported, which were at the same time attested by the originals or officially certified copies of documents.

All notifications of changes should be made in accordance with the structure of the natural person’s questionnaire.

Let me give you an example:

  1. After issuing the certificate of a natural person, the applicant shall report a change in item 12.11 of the financial obligations – e.g. a loan with KB a.s. in the amount of CZK 350000, which he does not provide with the original or an officially certified copy of the credit agreement or only with an uncertified copy and is not invited by the Office to provide it.
    In this case, if the holder of the public document submits another application in accordance with the law, he/she is obliged to reinstate the above-mentioned change in the questionnaire of the natural person and at the same time substantiate it with the original or an officially certified copy of the credit agreement.
  2. After issuing the certificate of the natural person, the applicant shall report the change in item 12.11 of the financial obligations – e.g. a loan with KB a.s. in the amount of CZK 350000, which he shall directly substantiate with the original or an officially certified copy of the credit agreement or do so on the basis of a request from the Office.
    In this case, when submitting another application under the law, the above-mentioned change does not have to be reinstated in the questionnaire of the natural person and at the same time it is no longer supported by the original or an officially certified copy of the credit agreement.
