A party to proceedings shall have the right, upon submission of an application for the issue of a certificate of security capability (hereinafter referred to as the ‘application’), to withdraw that application until the decision on the application submitted has become final (Section 113(1)(a) of the Act).

In such cases, it is necessary to send a written communication to the Office that the natural person/participant withdraws his or her request for the issue of a document. It is necessary to specify the person (name, surname, social security number or date of birth, place of residence), the request (type of sensitive activity) and to sign the communication. On the basis of this communication, in accordance with the provisions of Section 113(1)(a) of the Act, The Office shall close the pending proceedings and issue a decision to close the proceedings, which shall be served on the party to the proceedings.

The above facts also concern the withdrawal of the appeal against the decision given, since the decision in the case itself has not yet acquired the force of res judicata. The same rules apply to the withdrawal of an application for the issue of a certificate of a natural person or for a certificate of an entrepreneur.
